DIN has been introduced in India by way of Companies Amendment Act, 2006. Whenever the Director wish to appoint on the Board of the Company and the any person wants to be appointed as Designated Partner in the LLP then he / she have to apply for the DIN in form DIR-3 to the Central Government through MCA portal.

What is DIN?

Where is DIN used?

Whenever the Director wish to appoint on the Board of the Company and the any person wants to be appointed as Designated Partner in the LLP then he / she have to apply for the DIN in form DIR-3 to the Central Government through MCA portal.

DIN for Foreign Nationals and NRIs

Foreign Nationals and Non Residents of India and Persons of Indian Origin (PIOs) can also apply for allotment of DIN for by submission of necessary documents and proofs duly notarized and apostilled or consularised.

Passport is very and basic document for any Foreign Nationals and Non Residents of India and Persons of Indian Origin (PIOs) for making an application for allotment of DIN. If passport does not include date of birth, then an additional proof containing date of birth must be submitted, duly certified or attested same as passport.

Further, in case of proofs which are in languages other than Hindi / English, the proofs should be translated in Hindi / English from professional translator carrying his details (name, signature, address) and seal and duly certified or attested. In the case of foreign nationals, translation done by the notary of home country is also acceptable for DIN.

 

Some Interesting facts about the DIN

  1. DIN is valid till lifetime once issued to any person.
  2. It is 8 Digit Unique Identification Number of Director used for multiple tracking.
  3. Fastest allocation of DIN. It is allotted immediately upon generation of payment challan on the MCA portal.
  4. DIN = DPIN. DIN can also be used as Designated Partner Identification number (DPIN). Both are the same.
  5. DIN can also be surrendered in case it has never been utilized after allotment by the MCA in form DIR-5.
  6. Once DIN is allotted, later on Director’s details such as name or address or mobile no. & Email ID can also be changed and updated by filing of Form DIR-6 separately.

How to make application for allotment of DIN?

 

It is very simple to make an application for the allotment of DIN. Section 153 and 154 of the Companies Act, 2013 read along with Rule 9 of the Companies (Appointment and Qualification of Director) Rules 2014 guide as to how to apply for allotment of DIN.

 

The following steps should be followed for application for allotment of DIN:

  1. Visit the Ministry of Corporate Affairs (MCA) portal and follow this path-

Home> MCA Services> E-Filing>Company Forms Download.

  1. Download Form_DIR-3and fill the form with required information and attach the copy of;
  2. Latest passport size colour Photograph
  3. Identity proof (PAN Card)
  4. Proof of residence (Electricity Bill orTelephone Bill or Mobile Bill or Aadhaar Card)

(The above point no. a) and b) need to be attested by a practicing professional either Company Secretary or Chartered Accountant or Cost Accountant.)

  1. After filling – up the form and attaching the required documents, sign the form using Digital Signature Certificate (DSC)
  2. Signed form has to be verified digitally by the director/ Company Secretary/ Manager, CEO/ CFO of the company. Earlier, it was verified by the practicing CA or CS or CMA.
  3. Application for allotment of DIN has to be filed with the prescribed fees.
